User name and password are considered a signature and acknowledgment from the costumer of his approval for executing any requests, services or orders of transaction, therefore, the customer alone is responsible for all processes executed through electronic channels. Any appeal over the fact that the passwords have been published or used by another party will not be accepted or acknowledged.
The Bank is cleared of any responsibility resulting from the costumer using any programs or devices that exposes the security and efficiency of the services leading to the costumer data being revealed.
The costumer is responsible for provision and maintenance of his own devices along with all the requirements of operating it including expenditures and calling fees related to connecting his device to electronic banking services and any fees required for any service provider of access to the internet.
The Bank reserves the right to add any fees or commissions for the costumer agreeing to using the electronic channel and benefit from the services provided through it based on the fees and commissions matrix issued by the Bank every now and then.
The Bank reserves the right to refuse any procedure or executing any instructions provided by the costumer without giving any justification for that refusal, (to clarify, because it does not comply with the enacted laws and regulations or banking practices, combating money laundry, or the instructions and laws of the legal control department). The Bank will not bear any responsibility what so ever for not being able to execute any of the costumer’s instructions due to technical issues or compelling force.
The costumer agrees, accepts, and commits to protecting the secrecy of the user name and password for electronic banking services whether it was coming out of the Bank or established by the costumer.
Costumer acknowledges that the bank, its’ affiliated entities and the bank employees are not responsible for any losses, damages, financial claim, or the like resulting from using the user name and password. The costumer commits to notifying the Bank in writing should he discovers that his username and password became known to others, so that the Bank will take the necessary procedures. The costumer is responsible for all his/her outgoing transactions and instructions until the end of the second working day of him/her handing the written notice to the bank.
The Bank reserves the right to cancel these services at any time without a prior notification of the costumer. The costumer may also cancel subscriptions via written request to the bank with his full responsibility over all processes and services conducted until the end of the second working day dating the notification of approving the cancellation.
The Bank gives no guarantees or commitments with regards to quality, speed, performance, accuracy or the like, and does not guarantee that the electronic services system is free of mistakes or flaws. The costumer acknowledges that the Bank bears no responsibility for anything related to that given no intended violation or negligence on the Bank’s behalf.
All data and information the user receives from the bank or any provider is documented, it is provided to the costumer as a token of doing all possible efforts to guarantee the user’s comfort, yet it is not guaranteed. Therefor, the Bank is not to be considered responsible for any shortage or inaccuracy of that data and information, its completion or availability, or it’s time of delivery, or any other decision taken in relation to using that data and information.
The Bank will not be responsible for any computer viruses, issues related to the provided information resulting from services provided by any party providing that information, or that may result from the personal computer of the user. The bank also bears no responsibility for any hack or piracy.
The costumer bears full responsibility in case of suspending any checks with objections over its fulfillment, and the bank bears no responsibility for that.
The Bank grants electronic banking services to companies’ accounts and/or joint accounts after all signatories of the company accounts and/or the joint accounts sign the subscription request form for electronic services, then all of them signing a delegation form delegating one of them or another person to use the electronic banking services. The username and password are considered equivalent to all of their joint, collaborated and combined signature, no appeal stating that the username and password have been published or used by any of the partners and/or the partners of joint accounts will be accepted.
This agreement is subject to and ruled by the laws effective in the State of Palestine, hence any of its terms is subject to the judiciary specialization of the Palestinian courts as long as it does not conflict with the rules of Islamic Shari’a.
The costumer admits and agrees that at the time of signing this agreement to subscribe for electronic banking services, has reviewed, read and agreed to the terms and conditions related to the services or requested transaction and agrees to adhere to it and to behave in compliance with it.
